South Africa: Second (2nd) Swine Flu (H1N1) case reported

According to SAPA (South African Press Association), a second (2nd) case of H1N1, a.k.a. swine flu / Swine influenza / Pig Flu, has been reported in South Africa today, by the Department of Health (DOH). According to an official, a 29 year old man, who lives in France, had arrived in the Country to visit his mother in Pretoria, and was found to be ill: is the latest victim of the Swine Flu.
When our service first reported on Swine Flu, when the Influenza strain hit Mexico, we listed many important facts, and preventative measures, as quoted from health authorities in Canada, and the United States of America: these are accessible here:

This included cautionary steps such as washing hands with soap or alcohol based cleansers, and using a tissue when one sneezes, then throwing it away.
One should avoid touching their eyes or mouth, and doing several other activities, when confronted with the danger of the disease. Previous reporting on the South African situation, by local press, had raised concerns over an alleged inadequacy of medical treatment supplies, should a pandemic of the disease break into South Africa. Thermal (Heat) sensors at local International Airports, aimed at catching drug smugglers, were thought a way to notice whether or not someone had the illness.

Update: Caritas Internationalis grouping "cleared" by their Canadian Bishops' Conference superiors via probe in which their accusers had no voice

Background, controversies, and abortion
The Canadian Bishops, themselves have not been free from controversies involving abortion, with many bishops previously supporting a march by pro-abortion groupings (as our service among others had reported), nor is Caritas Internationalis free from accusations that its international funding helps support abortion, or other such activities, one noted controversy involved Caritas Christi, a member of Catholic Charities, which is a US member of Caritas Internationalis.
Despite all this, as our readers are aware, Leslie-Anne Knight, as Secretary General of Caritas Internationalis, had informed our service that no Caritas funding went towards support of Abortion, and that the grouping is loyal to the church. She did not inform us whether or not donations to Caritas Internationalis in general, went to the Canadian branch, and would not answer our further questions.
Our service also reported on alleged threats, which were emailed to us, by important unofficial, but fully verified representation locally, of the interests of Caritas Internationalis. We also noted odd activity on our site by a Vatican based computer or computers. We further found out that our twitter site, was suddenly being followed by differing International Caritas sources, having written on the issue, and published our interview with Leslie-Anne Knight.

We have now been emailed by a source in the Local Southern African Hierarchy, with an email containing the contents of a Zenit News Service Article, itself largely based on an interview that Salt and Light Television conducted with a noted source who is: claiming that Caritas in once again, innocent. The email did not follow the protocol of emails sent out to their general press releases lists, but rather that of the individual emails we have received in the past: seemingly directed only at our service. The recent email we received: is verifiable, from a local hierarchy source.
Development and Peace, accused of using funding collected in Parishes: to support organizations promoting abortion:
In response to claims of Canada's Caritas Organization, Development and Peace: allegedly funding pro-abortion activities in Mexico and in multiple different countries, on multiple continents, to those accusations from from many sources: including LifeSiteNews (Canadian), National Catholic Register, and So-Con-Or-Bust (Canadian), many of which were reported by Catholic Culture, and also independently by ourselves:
The Canadian Bishops conference, which likely controls, or has authority over the structural Development and Peace, quite publically launched a probe "facilitated" by Development and Peace, which was under investigation. The probe was not co-facilitated by any of the organizations, or journalists making accusations against a structure controlled, and funded by the local Bishops' Conference in Canada.
Archbishop James Weisgerber: report will Vindicate Caritas Internationalis' Development and Peace:
Archbishop James Weisgerber, president of Canada's Bishops' conference (c.f. Zenit news article), who is the Archbishop of the Archdiocese of Winnipeg, has reportedly told media, in a publicly aired interview, that a probe by the Canadian Bishops, who are the hierarchical superiors of Development and Peace, will vindicate the organization of accusations that it was promoting abortions in one specific incident: the situation in Mexico.
Probe isolated, not independent, did not adhere to so-called Natural Justice Principles, and was conducted by the very Bishops who gave over funds collected in Parishes: to Development and Peace:
The probe was confined to Mexico, when the accusations of irregular spending of funds collected in Canadian parishes: were international. The probe into the accused: was facilitated, by the accused : Development and Peace, and conducted by their superiors, who had collected money in parishes for the organization. The probe was not independent, and the multiple international accusers of the organization, among them well-known sources: were seemingly not given a chance to prove their statements, or to help "facilitate' the probe, as Caritas had been allowed. The bishop, also admitted, that they were reliant on Development and Peace: who are accused of supporting groups promoting abortion, to get around Mexico.
According to Zenit News:
"Archbishop Weisgerber acknowledged that some of the agency's partners are collaborating on separate projects with groups that adhere to principles opposed to Catholic teaching. He insisted, though, that the support given by Development and Peace is directed to specific projects that are not in violation of the Church’s position on abortion and contraception.
Objectivity
The report is based on a fact-finding trip to Mexico from April 15-18 conducted by officials from the bishops' conference and Development and Peace. The agency's involvement in an investigation of its own partners has raised concerns about objectivity, but the archbishop dismissed those fears, saying that Development and Peace simply facilitated the visit and had no role in the writing of the report."
They further note, that:
"earlier this month when Archbishop Weisgerber received a letter from Archbishop José Eguren, president of the Family, Childhood and Life Commission of Peru's episcopal conference, demanding that the Canadian agency cease funding pro-abortion groups in Peru."

Archbishop: of organization they fund: We are the Final Authority, accusers do not know "what it 'really' means to be Catholic":
The news service quotes the Archbishop who claims Caritas' Canadian Branch is innocent, ignoring that among the accusers, were clergy, he attacks all the independent investigations: as saying:
""I think the issue here is, who decides what it really means to be Catholic? And I think this is where we have had a little difficulty when people are going to Web sites to decide what it means to be Catholic rather than turning to the bishops,""Seeming Irregularities (Analysis)

The real question is how Catholic it is to attempt to alter how Catholic press portrays your organization, with private and public threats. As there are many bishops among those who were concerned about this incidence, and as this probe was effectively internal, and had no real external component, and as the Bishop in question, admits openly that Development and Peace partners, are involved in activities contrary to the teaching of the Catholic Faith, this release by the bishop, hardly vindicates the Organization, or the fact that his episcopal conference has funded, and supported the grouping they themselves were investigating.
Editorially: Money spent on one project, frees up money for others, money allows more marketing, a charity is a system, and every part benefits from the success of other parts. Funding just one part of a charity, certainly aids it in other areas, and promotes its' goals. These goals, seemingly can be support of abortion.
As if to further call his own statements into question, the Archbishop in question reportedly admits:
""Development and Peace wants to work very closely with the bishops to develop new protocols to make sure that their adherence to Catholic principals is more carefully formalized.""Analysis of the fact, we were directly informed of this by SACBC (Southern African catholic Bishops' Conference) representation:

We are unsure of the purpose in informing us of this article, was: by representation of the local Bishops' Conference in Southern Africa: whether to agree with the Archbishop quoted from Canada, or to vindicate our own service's independent investigation, which caused some tensions between us and some hierarchy figures. From what I personally have read, this hardly clears the organization, especially given some links on their website's external links section: to some questionable groupings, and the multiple accusations from multiple, international sources. Their Umbrella Organization's treatment of our own service's independent review of this situation, was behind the scenes: in the least bit suspicious.

Social Justice South Africa: ANC want to Bring back Apartheid Era Parliamentary Supremacy?

The following article does not constitute a legal opinion, and does not constitute a grounds for further action. Our facts as to the current situation, though not the previous ones (e.g. Collins case, etc, which are not based on IOL's "Sunday independent" article): are based on an article which appeared in the Sunday Independent, on Sunday 14 June 2009.
The Collins case, and Parliamentary Supremacy
Collins V the Minister of the Interior, was an important case in South African legal history, it was when the Nationalist Party (Now incorporated into the ANC: African National Congress, which is the ruling party in South Africa), managed to get past the then Constitutional requirements of the Union Constitution, 1910, which was achieved via the Senate Act, against coloured voters which had been in the way of the Apartheid Government.
It is then, when coloured voters were finally thrown off the Common voters' roll.
ANC wants to amend Separation of Powers
With the Constitution of the Republic of South Africa, 1996, so-called "Constitutional Supremacy" definitively, replaced the "Parliamentary Supremacy" of the Apartheid era. With a new bill, fronting an adaption to the Constitution, and to the process of regulating judiciary, South Africa's Constitutional Supremacy, and Separation of powers, seems more than at risk! And under such a communistic government, as the ANC's cabinet, with such a history of seemingly endorsing corruption, and passing laws, which favoured its members, and those of certain ethnicity over other persons, this is concerning!
Previously known as the "Superior Courts Bill", the "Constitution Eighteenth Amendment Bill", has some sections the ANC's Justice Minister: Jeff Radebe, will not negotiate, according to IOL: these the ANC: insists, must occur:
"The non-negotiables, however, include:
The chief justice will become the head of the judicial authority;
The Constitutional Court will become the apex court, able to hear all cases, not only constitutional matters;
The Constitutional Court will no longer be able to prevent an act of Parliament from coming into operation."

Context of Quote:
The Chief Justice of The Constitutional Court is directly appointed by the President. It is expected, that President Zuma, desires a staunch ally in the post. The Constitutional Court, does not have the capability to hear many more cases, and some justices (judges) of it, according to legally related opinions I have read in my textbooks, are allegedly specialists in what the author considered "Human Rights" or maybe just Constitutional law, and possibly have no real ability in statutory, or common law. Every Act can currently be judged against the Constitution, as Constitutionally valid or invalid, such has yet to be abused.
The ANC is just- about: three seats short of the Two Thirds Majority in Parliament needed to unilaterally change the Constitution: however, the PAC, the ID, and the ACDP have all previously acted as ANC allies. It is very possible, that despite the Best Efforts of the Major Opposition, that the ANC, will finally be able to pass a bill, maybe equivalent to the Senate Act, by which the Nationalist Party Instituted Apartheid's Parliamentary Supremacy, and cleared the path for its many alleged abuses.
Current Government's Confrontational history with Courts, and Prosecutors:
The current President of South Africa, who was let off on hundreds of corruption charges, after his organization got rid of the previous National Director of Public Prosecutions, and the federal unit, which was investigating him and others for alleged corruption, has likened the judges to people who think they are "God", and has often been a cause for concern, as regards fears that he will entirely erode Judicial Independence in South Africa. He has also claimed that White South Africans, who are not of Afrikaans ethnicity, are not really South Africans. He seemingly claimed that the ANC, had never altered the 1996 Constitution, and wouldn't do such during his term. The first claim was an outright lie, or erroneous statement, as anyone who has even glossed the Constitution can tell, or it was entirely misquoted: which is highly unlikely, the second clearly seems to be just as much of a false claim, at least as far as the ANC's seeming intentions seem to go.

Venezuela: Socialist Hugo Chávez' Government: continues to subvert Venezuelan Bishops, sees them as threat
Catholic Bishops are "Spreading Hate": said Tareck El Aissami, in response to update Bishops gave papacy:
Interior minister, of the Bolivarian Republic of Venezuela, Tareck El Aissami, has accused the Roman Catholic Bishops in his nation, of becoming a political party of sorts, and of being guilty of spreading hate.
This follows statements by Archbishop Ubaldo Santana to current Pontiff, Benedict XVI, during the bishops' recent Ad Limina visit to the Vatican. In accords with the general norm of Ad Limina visits, the Archbishop, had informed the pontiff of his view of the situation of the Catholic Church in his region, whereby he has said of Chavez government, that "a growing political polarization has increased violence, insecurity and hatred, seriously jeopardizing peaceful democratic coexistence."(Catholic News Agency (CNA) (Catholic; independent; American) 12 / 06 (June) / 2009 ).
Venezuelan Interior Minister: Bishops are so mislead, that he must say "God Forgive Them, They Don't Know What They Are Saying"
In the Interior minister's attack on the Roman Catholic Church, the Venezuelan Minister further said: "God forgive them, they don’t know what they are saying," (a seeming reference to Christ being crucified on the cross, forgiving his killers) of the bishops, having already said: that if "If anyone has spread hatred in Venezuela", it was the Catholic bishops's Conference stationed in the his party's Socialist ruled Country.
During January, the: Vice President of the EU (European Union's) Parliament: Mario Mauro (Archive: 23 / Jan / 2009) , who was also the representative on religious persecution in the: Organization for Security and Cooperation in Europe, had already in January this year, said that basic "liberties", were being scraped away from Venezuelan citizens. In this statement, he implicated the Venezuelan Government!
Responding to the concerns, and status reports given by the Bishops, the Holy Roman Pontiff: Pope Benedict XVI, had said (loose translation via machine:)

In what is seen as payback, for the direct and open opposition to "Populist" Venezualan President Hugo Chávez's Socialistic party, during previous democratic action: the National Assembly, of the Venezuelan Republic (officially: "República Bolivariana de Venezuela"/" Bolivarian Republic of Venezuela"), has made a statement against the Catholic Bishops in his country. He did this, while apposing what the Church considers as their Canonical right to suspend two priests, who refused to perform the Feast Day Mass set for the day, and instead, celebrated a Mass following a political concept in support of the ruling socialists's agenda.
Father Máximo Ochoa and Father Edmundo Cadenas, in defiance of their bishops, and in support of the Socialist government: celebrated a so-called "People's Mass", on a traditional Roman Catholic Feast Day.
While our service does not have the facts, this could refer to a "Day of Obligation", when Catholics are "obligated" by the Catholic Church to attend a Mass in honour of a certain aspect of the Catholic Faith.
Holding a Mass, in honour of politicians on a Feast Day, could be seen as political subvertion against the bishops, and essentially as a minor act of schism. The bishops, who were defied by the two, reportedly had had them suspended until they revoke their actions of seeming schism.
Following this, on May 14th 2009: the two: Fr. Máximo Ochoa and Fr. Edmundo Cadenas, whom "Rorate Caeli", claims are connected with Populist Venezualan President Hugo Chávez's Socialistic Ruling party, testified in the Venezuelan Parliament's National Assembly, against their Bishops:
"“We have done no crime in order to apologize. We would rather walk along with the simple folk, our people, according to Liberation Theology, than with the dominating class. The reprisal happened [for choosing] to lead a Christian life and for the preferential option for the poor."According to "Rorate Caeli", the country's National Assembly, then,
“The Bishops suspend us, but the people absolve us,” they added.

VIS: Church needs to further combat human trafficking!

"CONGRESS OF RELIGIOUS AGAINST HUMAN TRAFFICKING
VATICAN CITY, 12 JUN 2009 (VIS) - In the Holy See Press Office this morning, a press conference was held to present a forthcoming congress on the theme: "Female Religious in Network against Trafficking in Persons". The event, due to be held in Rome from 15 to 18 June, has been organised by the International Union of Superiors General (UISG) and by the International Organisation for Migration (IOM).
Participating in today's press conference were Fr. Eusebio Hernandez Sola O.A.R., bureau chief at the Congregation for Institutes of Consecrated Life and Societies of Apostolic Life; Sr. Victoria Gonzales de Castejon R.S.C.J., secretary general of the UISG; Carmela Godeau, vice head of mission of the IOM; Sr. Bernadette Sangma F.M.A., and Stefano Volpicelli of the IOM.
"The problem of human trafficking represents a new form of slavery of the twenty-first century, one that offends the dignity and freedom of many women and minors, but also of youths and adult men, most of them from poor countries" said Fr. Hernandez Sola. "These new forms of poverty remind us that religious life is, by vocation, called to play a prophetic role in society and the Church today. A new conception of charity must carry consecrated life to the new frontiers of evangelisation, and to the new forms of poverty, among the most serious of which is the loss of personal dignity".
For her part, Sr. Bernadette Sangma explained that awareness about the phenomenon of human trafficking has increased to such an extent over the last few years that "some congregations ... have adopted the struggle against trafficking as part of their capitular deliberations, making it an obligatory mandate for members of their congregation. This has also included a number of male orders".
"Given the complexity of the factors involved in human trafficking, networking in this field is not an option but a necessity if we hope to make any kind of strategic commitment. The criminal bands that prey on women and children are highly organised and linked to one another, from one part of the world to the other. Only through a networking strategy which includes the victims' countries of origin, of transit and of destination, will it be possible to implement measures to prevent the weakest and most vulnerable people from becoming human merchandise".
Sr. Victoria Gonzales de Castejon noted how, for the religious of the UISG, the last six years of collaboration with the IOM have provided "an opportunity to put the intentions of the Union into real effect, and to increase the scope of our actions aimed at contrasting human trafficking. ... What emerges clearly from the work that has been achieved is the richness and complementarity in exchanges and collaboration between two organisations that represent public and the private aspects - lay people and female religious - in the common cause of defending the lives of people who live in situations of poverty and marginalisation".

Vatican compared to North Korea by Libyan leader: permitted to give speach in Italy's Senate

Controversial, and vocal billionaire: Italy's Prime Minister: Silvio Berlusconi, has been pulling out all the stops for the infamous Libyan leader: Colonel Muammar Gaddafi, of whom Reuters reported, on Thursday, as having spoken to Italian Senators, having been invited to speak to the Italian Senate. In this speech, he seemingly compared the Vatican to North Korea, and further, to Afghanistan under the Taliban. He made Saddam Hussein out to be a hero, and neglected some facts in a contentious speech.
Continuing his not unexpected attack on the Western World, the Libyan military dictator, continued: comparing a U.S. (United States of America) plane strike in the '80's, which killed his daughter: to an Al Qaeda attack. Here, ignoring the Libyan counterstrike, against an Island, and not against America, he treated America as a Terrorist.
A quotation of the first comparison, by Reuters which notes of the Dictator's speech: while quoting the dictator is:
"[The Libyan leader was] Arguing that the world should have room for "regimes of all kinds" including "revolutionary" Libya, he asked: "What's wrong with North Korea wanting to be communist? Or Afghanistan being in the hands of the mullahs? Is not the Vatican a respectable theocratic state with embassies all over the world?""A second quotation, of such a question put forth by the Dictator, from the same source: on the speech is:

""What difference is there between the American attack on our homes in 1986 and [B]in Laden's terrorist actions?" he [the Libyan leader] asked. "If [Al Qaeda leader: Osama] [B]in Laden has no state and is an outlaw, America is a state with international rules.""
As the apparent World Economic Crisis, has continued to unroll, Europe, also has become increasingly aware of their needs of, and dependent on Russian oil, and gas. Italy, seeing gloom and doom on the horizon, has increasingly attempted to attract investment from Libya in its companies, and currently buys about one quarter (1/4: 25% [Twenty-Five Percent]) of their oil and over 30% (Thirty Percent) of their gas, from the infamous North African dictatorship/nation (c.f. . EuroNews (Secular; French; very Liberal/Leftist) 10 / 06 (June) / 2009 ).
Silvio Berlusconi's recent dealings with Libya, including the turning away of refugees (at least about 37 000 (Thirty-Seven Thousand) a year attempt the trip to Europe via Italy, while several thousand have already allegedly been towed back to Libya: c.f. . EuroNews (Secular; French; very Liberal/Leftist) 10 / 06 (June) / 2009 ): and their direct deportation back into the military dictatorship: Libya, without any consideration of asylum, has gained Italy: Vatican Criticism, as well as that of groupings purporting to promote the Western Value of Human Rights.
Berlusconi, is an important representative of the Right Wing of Italy's political spectrum, which generally gains the support of some church figures for anti-euthanasia etc stances, despite this religious support for his side of Italian politics (Excluding aspects inter alia of his Human Rights Record): he has been accused of multiple sexual flings with actresses, and (by left leaning AFP) of only falling for the woman he had married, after seeing her upper half, as she performed (as an "actress") with a certain lack of attire on stage. While his public opposition to some extent against Euthanasia, and other such positions he's taken, against extremely left-wing incursions into Italy, have gained much support from the Vatican. Some other choices, including his personal life choices, and his alleged human rights ignoring policies regarding refugees, have gained strong criticism from Church, and societal figures.
His dealings with Refugees, desperate to escape their harsh, and controlled lives in Libya: have gained Berlusconi a harsh reputation as regards some aspects of (UN Defined version of) Human Rights. International sanctions against Libya, were officially ended in 2003, when the African dictatorship, decided to officially end development of what Reuters, in their article: has termed "Weapons of Mass Destruction".
When comparing the Vatican to North Korea, and to previous Afghanistan, the Libyan military dictator, who came to power in a coop, was attempting to justify the practices of what are known internationally as pariah states. He particularly noted the Vatican, a center of some notable moral and spiritual power in the Western World as what he termed a "theocracy": ignoring the fact that all citizens of the Vatican, except the pope are temporary, and that its laws, until recently, under recent Italian governments: had been based, not on theology, but on Italian law, and that it still largely bases them on Italian Laws: but with mind to choose which new laws to adopt.
The fact, that Berlusconi, has allowed the infamous dictator, to visit Italy, and that Italy, last year had agreed to pay, and did pay: a vast sum of about Five Billion US Dollars to Libya in reparation for alleged Italian Human Rights abuses under the equally infamous fascists, during colonialism (the current Italian government does so: ignoring Libya's alleged ongoing abuses of what are known as Human Rights, despite such government paying for previous alleged ignoring, or abusing of Human Rights?), and that the Libyan Dictator: wore a photograph, showing a revolutionary (Omar Al Mokhtar: so-called "Lion of The Desert"), who the Italians allegedly put to death, during their Fascist lead occupation of Libya, certainly seem to say that this move by Italy's government, is due to the economic profits to be gained from the deal.
Italy's Left, which is often noted for disagreement with the Church, and for the Vatican's disagreements with it: has taken a stance against the privileges given the infamous dictator, with a major leftest party, directly questioning the visit.
It must be noted, that Italy's occupation of Libya, under Fascist rule, is very likely to have had an administrative purpose, which committed atrocities, but further, that ignoring of current issues, seems to make reparations only symbolic.
Leftest students, had hurled smoke bombs, as well as red paint which hit police shields, as the Colonel in Charge of Libya, visited an Italian university, and the Left-Wing, had today prevented the dictator from speaking in the main Senate Chamber, even though the Libyan leader, had been allowed, in any case: to speak to the Italian Senate.
What has made most headlines, is the Libyan's comparisons: connecting the West, with terrorism, and other such things. When speaking of a U.S. air-strike on Tripoli, he did not mention the Lybian response, which was aimed at seeming innocents also.
The Libyan Dictator, is staying in a tent erected at: "Villa Pamphili" (BBC World News (British; Secular independent) 10 / 60 (June) / 2009 ;), in Italy's Capital City: Rome, during his three day visit.
The Italian change of Policy was, perhaps best put by Italy's Prime Minister, on Wednesday, while greeting the Libyan leader:
""This event symbolises a great change in the relations between Italy and Libya after many difficult years...""

While controversial, the new trade ties between Italy, and Libya, follow a general international trend, which has seen many Western Nations, opening trade relations inter alia with China, with Russia, and with many other Nations, which still have poor records in Democracy, and as regards Western beliefs about Human Rights. While the opposition in Italy, is certainly being sure to make a fuss about the visit, both the Left Wing and Right Wing of global politics, have increasingly opted for convenient economic solutions, with leaders such as the Libyan one.
With the Global Economic Crisis, taking a focus, as with Global Warming: there are increasing fears that Humanitarian Situations, and the plight of citizens who have little say in their conditions, will increasingly take a back road, to convenient economic and social policies.
Libya, currently hold the rotating chair of the presidency of the African Union (AU), despite it's record on human rights. Something not unusual in many African States.

Brazil: Archbishop José Cardoso Sobrinho joins accusations against Vatican based paper: of anti-life "bias"

For some time now, it has been an issue of contention, with accusations in the air, that L'Osservator Romano, has been tainting their articles with a strong pro-abortionist slant. Now, Archbishop José Cardoso Sobrinho, has joined sources, such as "Catholic Culture", in attacking the Vatican based (though not Vatican vetted) newspaper based on his perception that they had slighted him.
Our readers may remember our story on a 9 year old girl, who was allegedly continuously raped by her step-father, with no intervention from the mother, and how the mother forced the child to have an abortion, instead of the alternative of a medical procedure, which would have allowed the offspring of the girl to survive. This despite the hospital where the child had first been investigated: firmly noting that there was no risk to either child, or her twin offspring, should she continue with the pregnancy: in their medical opinion.
They (Readers) may remember, that Archbishop José Cardoso Sobrinho, had used what power he had in Canon Law, to note that the seeminly negligent mother and the doctors, who had killed the 9 year old's twin offspring (though not the child, who was too young), had incurred automatic excommunication under the 1983 codex of Canon Law. As Canon Law does not prescribe an automatic (Latae Sententiae) excommunication for crimes, which are terrible, but not considered genocide (Abortion: article 2, section d, UN (United Nations's) declaration on the Crime and Punishment of Genocide (before America and Britain legalized abortion): the Catholic Church, has itself: defined abortion as as bad as genocide, in Vatican II, Gaudium et Spes): such as serious common-law crimes as rape, the archbishop, was unable to declare the step-father excommunicated, without an investigation into inter alia: whether or not the step-father had raped the child, which would need to be conducted by the church. As the abortion was clearly, openly, defiantly, and publicly done, and, under Canon Law: is a different category of crime (possibly including heresy), the mother and doctors who insured the twin offspring were killed, had been excommunicated. The Archbishop, had simply reaffirmed a fact, which had already occured, "spiritually", and with automatic effect, directly from the knowing performance of the Canon Law Crime against the Catholic God (according to Vatican II), of the perfoming of an intentional direct abortion, or aiding and abetting it.
The girl's parish priest had further driven hundreds of miles daily, and offered to take every measure and the church has many, in order to care for both the young girl, and for her two healthy offspring, despite playing no part in the tragedy. Instead, the mother did everything in her power to insure an abortion, and was quick to get her daughter (abused under her care), to undergo an operation, where doctors directly, knowingly and intentionally killed her two offspirng.
Instead of praising Archbishop José Cardoso Sobrinho, of Recife and Olinda, as Cardinal Re, Prefect of the Congregation for Bishops, had: the President of the Pontifical Academy for Life, Archbishop Salvatore Fisichella, had in March heavily criticised the Brazilian Archbishop: noting that he should have emphasized "mercy". The President of the Pontifical Academy of Life, used L'Osservator Romano to do this.
The Archbishop: Archbishop José Cardoso Sobrinho, has raised concerns over L'Osservator Romano: claiming that they refused to publish his side of the story (which our service still hasn't heard), while publishing negative, even patronising criticism of the Archbishop, by Archbishop Salvatore Fisichella, the President of the Pontifical Academy for Life. He (The Brazillian Archbishop) further claimed that the Vatican based (though not Vatican vetted) paper's article was factually incorrect.
Writing on this situation, Fr. Tom Euteneuer, the President of Human Life International: noted:
"The incident in question involves — unbelievably — the head of the Pontifical Academy for Life, Archbishop Rino Fisichella, who issued a statement on March 15th criticizing a bishop in Brazil for properly declaring to be excommunicated the doctors who performed an abortion on a nine-year-old girl who was pregnant from rape. The girl was pregnant with twins so the doctors aborted two babies. Despite her young age, she was not in any serious danger (according to the hospital), nor were the two babies she was carrying in any danger. Even if she would have been in danger, the abortion would have been immoral because the direct killing of the innocent never is allowed. It goes without saying that the Church condemns unequivocally the incestuous act committed against this young girl, however, the issue of excommunication of the perpetrators of the abortion stands on its own and deserves applause, not criticism by other prelates. Unfortunately, Archbishop Fisichella is not the only bishop to publicly criticize the decision of the Brazilian bishop in applying church law.
The innocent little girl, thus, became the center of a perfect storm created by the abortion industry which capitalized on her victimization to promote abortion in Brazil where it is currently illegal. Unfortunately, Abp. Fisichella’s intervention gave the impression of a quasi-doctrinal statement and played right into the hands of the abortion promoters by seeming to give permission for abortion in such a “hard case” scenario. Archbishop Fisichella was not condoning these abortions per se, but due to some unfortunate choices of words in his article, and predictably, on the very day that Abp. Fisichella issued his statement, the Associated Press picked it up and titled their own article, “Vatican prelate defends abortion for 9-year-old.” The world is indeed watching and listening to what comes out of the Vatican because of the Holy See’s immense moral and spiritual authority; hence the responsibility to be loyal without fault when speaking in the name of the Catholic Church.
I applaud most of all the handling of this case by the local diocese in Brazil and pray that all bishops may take an example from this picture perfect handling of a difficult pastoral situation. Credit needs to go to Archbishop José Cardoso Sobrinho and several priests of his diocese for providing generous pastoral care to the family during this terrible crisis. Indeed, when the girl was transferred to a hospital 140 miles from the parish, her priest travelled that distance every day to visit her and to assure the family that the Church would provide every possible care for the welfare of the three vulnerable children.
The great irony in all this is that while we get little or no support from Church officials to correct bishops who are negligent in their duty to guard the faith and the flock, in this case, the local bishop did exactly the right thing in issuing this excommunication edict and he was slapped down by a Vatican official!
The appearance of a Vatican compromise on this issue comes at the worst possible time in the cultural and political situation of Latin America. This Catholic continent is especially the target of attack by the aggressive forces of the culture of death, so the last thing we need is for the Church to look weak or divided about our teachings or our resolve to fight the purveyors of death to our brothers and sisters there. The Catholic Church, and her divine authority, is in many places the only shield that the unborn have to keep the abortionists’ instruments of death from them. Let us pray that the Vatican will rectify this error and fortify that shield without delay. The unborn children of Brazil as well as all other parts of the world are counting on us!

According to LifeSiteNews, which quotes the Brazilian Archbishop, as he was quoted in French media:
""We sent the archdiocese’s response to Mgr Fisichella’s article to Rome. It’s a natural right to be allowed to respond if someone has been publishing false information, for who knows which motive: the readers of L'Osservatore should also be in a position to know the other point of view."
The article, entitled "On the Side of the Brazilian Girl," shocked the pro-life world by defending the doctors who killed the unborn twins of a nine-year-old child in Recife, Brazil, and criticizing Cardoso for announcing the automatic excommunication from the Catholic Church incurred under Church law for committing an abortion.
Cardoso observes that the piece by Fisichella contained raw factual errors. In particular the article implied that the world would never have known about the case if the Archbishop had not mentioned the excommunication, suggested that Cardoso had immediately announced the excommunication without prior contact with the media, and that the girl's life was in danger from the pregnancy.
In reality, the Brazilian media had already been reporting on the girl's situation for several days, and the hospital where she was initially admitted acknowledged that she was in no danger at the time of the abortion (see LifeSiteNews' extensive coverage).

Representatives of the Brazillian Bishops' Conference, had already, as had Cardian Re: made a statement in support of the Brazillian Archbishop. The Catholic church teaches that rape is not an adequate reason for the procurement of an abortion against an innocent life. In the case of a Cancerous womb, where another option does not exist, the church allows the removal of the womb, but while the womb-bound child may die from such, the intent is not to kill the child, as any abortion will always include as an intent. As the child is not an "unjust agressor", it is very unlikely that the Law of Dual Effect, can be applied to abortion.
Editorially: The general bias again the Fetus (Latin for offspring), is quite clear: in that when an abortionist, who killed children, who were capable of surviving outside of the womb (Dr George Tiller, the Kansas Late Term Abortionist), was assasinated at his church, where he was an usher: there was outright condemnation of the anti-life act, of killing him, despite the many he had killed: but when a woman is raped, it is adequate justification, in the eyes of many legal systems (created by politicians, who are empowered, often by Catholics): to kill a child, who has yet to commit a single wrong.
